1. The service and these terms

These terms govern your use of VfxSmith at vfxsmith.com, including its AI creation workspace, asset management, team features and paid services. “VfxSmith,” “we” and “us” refer to the operator of this service, reachable at xu250618@gmail.com. By using the service, you agree to these terms. If you do not agree, do not use the hosted service.

Our Privacy Policy explains how we handle personal information. The separate open-source licenses linked on our Source & licenses page govern the materials to which they apply; these terms do not reduce the rights granted under those licenses.

2. Eligibility and accounts

You must be at least 13 and meet the minimum age for online consent in your location. If you cannot enter into these terms independently under applicable law, a parent or legal guardian must authorize and supervise your use. If you act for an organization, you must have authority to bind it.

Use accurate account information and keep your Google account and signed-in devices secure. You are responsible for activity you authorize through your account and for managing team membership and permissions. Notify us if you suspect unauthorized access. Signing in does not itself start a paid subscription.

3. Your content and generated assets

You retain any rights you have in prompts, references and other content you submit. You must have the rights and permissions needed to upload that content and have it processed by the service and its providers. You grant us a non-exclusive license to host, copy, process and transmit that content as needed to operate the service, generate results, save your work and provide sharing features you select.

As between you and VfxSmith, we do not claim ownership of your original generated output. You may use and modify output, including in commercial projects, subject to applicable law, third-party rights and any licenses attached to source materials. This does not guarantee that AI output is copyrightable, unique or free from third-party claims. Other users may obtain similar results.

The free library and output incorporating upstream code or effects remain subject to the relevant licenses. In particular, preserve the copyright and permission notices required by the MIT-licensed pixelfx library by Patch and its contributors. Review Source & licenses and the notices included with downloads before distribution. These terms do not imply endorsement by Patch or other upstream authors.

4. Acceptable use

Do not use VfxSmith to violate law or others’ rights, upload content you are not entitled to use, distribute malware, steal credentials, access another user’s private data, harass others, or create unlawful exploitative content. Do not bypass authentication, billing, usage limits or access controls, interfere with the service, or use automation that unreasonably burdens it.

Do not submit passwords, payment-card details or sensitive personal information in generation prompts or reference content. Review generated code and files before running or distributing them. You are responsible for deciding whether an asset is suitable for your game, engine, audience and intended use.

5. AI generation and availability

AI output can contain mistakes, unwanted artifacts or unsuitable code, and may require further editing. We do not guarantee a particular visual result, compatibility, uninterrupted availability or that a request will produce usable output. Generation modes, models and limits may change as providers and the service evolve.

Keep your own exported copies of important work. The service is not a guaranteed backup or permanent archive. We may perform maintenance or change features; where a change materially affects paid services, we will provide notice or remedies as required by law.

6. Subscriptions, credits and cancellation

Prices, currency, applicable taxes, billing frequency and included credits are disclosed on the account page and at checkout. Checkout details govern the purchase you authorize. Payments are processed through Stripe. A recurring subscription renews automatically until cancelled.

Monthly subscription credits refresh after a successful payment and expire at the end of their billing period; unused monthly credits do not roll over. Purchased and promotional credits follow the expiry terms disclosed for the relevant grant. Credits are service usage units, not money, deposits or transferable stored value.

Generation costs depend on the selected mode, model and actual usage. A run may reserve credits before generation; final usage is settled under the applicable billing rules and unused reservations are released. A result you dislike is not necessarily a failed request. If you believe a charge or credit deduction is incorrect, contact us with the relevant request or transaction reference.

Use Account → Manage subscription to cancel future renewals. Cancellation takes effect according to the billing portal confirmation; paid monthly credits remain available until that billing period ends. Signing out, revoking Google access or stopping use does not cancel a subscription.

Cancellation does not automatically refund past charges. Send refund and billing-error requests to xu250618@gmail.com; we review them based on the transaction, usage, service issue and applicable law. Nothing in these terms excludes mandatory refund, withdrawal or other consumer rights. If a payment is refunded, reversed or disputed, associated credits may be adjusted or placed on hold while the matter is resolved. Material price or renewal changes will be communicated before they apply as required by law.

7. Suspension and account closure

We may restrict or suspend access where reasonably necessary to address abuse, non-payment, security risks, legal requirements or material violations of these terms. Where appropriate and lawful, we will explain the reason and provide an opportunity to resolve the issue. Contact xu250618@gmail.com to request account closure or review of a restriction.

Before closing an account, export any work you want to keep and cancel recurring subscriptions through the billing portal, or ask us to assist with cancellation. Data deletion and retention are described in the Privacy Policy. Closure does not eliminate outstanding payment obligations or rights that already arose under these terms.

8. Disclaimers and responsibility

To the extent permitted by applicable law, the service and generated results are provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose or non-infringement. You should verify output and maintain appropriate backups.

To the extent permitted by applicable law, VfxSmith is not liable for indirect or consequential losses, lost profits or loss of data arising from use of the service. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including mandatory consumer protections. Third-party and open-source materials may have their own warranty and liability terms.

9. Changes, disputes and contact

We may update these terms and will identify changes through the date at the top of this page. We will provide additional notice of material changes and seek agreement where required by law. If you do not agree to an update, you can stop using the service and cancel future renewals.

Please contact xu250618@gmail.com first to help us resolve questions or disputes. These terms do not require mandatory arbitration, waive class-action rights, or take away any rights or access to courts that applicable law gives you. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
